A Public Prosecutor’s Commission in Serbia has started reviewing the decision through which Banjska’s chief terrorist, Milan Radojic, was released and had not been sent to custody following his arrest in October 2023.
According to the Serbian media media media medium, Noova.rs.rs, the commission is looking into the circumstances in which Radojic’s release was defeated, despite his taking responsibility for organising the terrorist attack in Banjska, where Kosovo Police Sergeant Africa Buxaku was killed.

Focusing on the review is the prosecution’s then request for the detention assignment. In it, the prosecutor had argued that there was danger of escape, but had not mentioned other circumstances that could justify the most serious measure of security.
It is the risk of repeating criminal acts, the possible impact on witnesses, and the violation of public safety. The very lack of these arguments is now being considered by the commission, according to the report of Nova.rs.
The Supreme Court in Belgrade had rejected the request for detention, praising that Radojic’s voluntary presentation and passport surrender were sufficient to ensure his presence during the procedure. Instead of custody, he had been confiscated from passports and was assigned to appear regularly in police.
Radojciq, former vice president of the Serbian List, had claimed responsibility for organising the September 24th 2023 terrorist attack on Zvecan Banisk through his lawyer. He had claimed to have acted without the knowledge of Serbian authorities.
During the attack, a group of dozens of armed men attacked the Kosovo Police, killing Sergeant Africa Buxaku. Three Serb attackers were also killed in armed clashes, while the rest of the group fled towards Serbia, leaving weapons, ammunition and explosives behind.
After the attack, Radojic had been arrested in Serbia, but the Supreme Court in Belgrade had released him in October 2023. Since then, Serbian authorities have not filed charges against him, while he continues to remain at large.
Even recently he has been seen in the election campaign, participating in activities supporting former Serbian President Aleksandar Vuciq during the 25 October elections.
Meanwhile, the Kosovo Special Prosecutor had filed charges against 45 people in September 2024 for involvement in the terrorist attack in Banjska, including Radociqi. The Act includes criminal acts related to terrorism and violation of constitutional order.
Kosovo has called for the arrest and extradition of the indictees, while for some of them, including Radocicin, have issued an international warrant via Interpol.
The European Union and the United States have demanded that those responsible for the attack face justice, while Kosovo continues to call on the international community to pressure Belgrade on the issue.
