Gervailla: Arlinda warned the assassination, institutions failed to act

Gervala announced that Arlinda Zekaj had sought institutional protection, reporting violence, threats and fears for her and the child’s life. On September 7th, she had sought an emergency defense order from the Constitutional Court in Pec, warning that her life was in danger.

Reresic was officially reported and documented, Gervala declared.

According to the report, the court had not respected legal deadlines for handling the request. Although the law envisions a seven-day term for decision-making, sessions were postponed several times, while the defence ordinance act was issued on October 16th, after more than a month.

Another disturbing fact, according to the minister, is that on September 17th, Arlinda Zekaj was addressed to the head of the Foundation Court in Pec, Shkumbin Haddrajna, warning of delays and danger to her life. The answer was received on October 20th, where the mayor had concluded that the judge had acted within legal terms.

However, Gervala said documentation and law show otherwise. That same day, Arlinda Zekaj had again written to the tribunal’s president, expressing despair and fear that he would be killed as a result of institutional neglect.

Five days later, she was brutally killed, the minister stressed.

The report also states that there is no implementation of the defence order. According to Gervala, on October 20th and 21st, the Centre for Social Work had announced the judge responsible for failing to implement the measures, but the documentation does not result in further legal actions.

Serious problems are also recorded in the Constitutional Prosecutorship in Pec. According to the report, the prosecution had been informed of the violence and threats to Zekij since July 10th. In fact, on October 23rd, just two days before the assassination, the then chief prosecutor, Joy Vucetaj, had been informed in writing that the victim had reported a direct murder threat by Albert Sylaj.

According to the minister, the prosecutor in charge had refused to open the case for deadlocking and had requested from suspected persons the security camera footage. However, there is no documentation that testifies whether these images were submitted and what actions were taken later.

The drill also raised concerns about the failure to raise Arlinda’s request to return home. Instead of implementing the judicial decision, she was recommended for the property issue to be resolved through civil procedures, while in some cases she was suggested to leave the house for security reasons.

So, instead of removing the risk from the victim, the victim was required to leave the danger by giving up her home, Gervala said.

As for the Centre for Social Affairs in Pec, the report states that the institution has had continued communication with Arlinda Zeqaj from July to October, but had not taken the necessary actions to create conditions for its return to the common house. The centre had also not in time delivered the report requested by the court, which had contributed to the postponement of hearings.

The minister also spoke of the responsibilities of the Peja Community in overseeing the Centre for Social Work, saying that until the report’s conclusion, only a brief response had been accepted from the municipality, without concrete measures related to the recorded shortcomings.

Meanwhile, Gervalla indicated that two prosecutors involved in handling the case have already been suspended from office. She stressed that this move does not imply final compliance with responsibility, but enables the development of relevant procedures.

The minister called for all institutional actions and inactions to be reviewed as a whole and for the responsible persons, where violations are found, to be taken by law.
